Terms Of Service
Effective Date: May 1st, 2026
These Terms of Service (“Terms”) govern the use of pest control services provided by Veterans Choice Pest Solutions, LLC (“Company,” “we,” “us,” or “our”), an Arizona-based pest management provider. By scheduling, purchasing, or receiving services from us, you agree to these Terms.
1. SERVICES PROVIDED
We provide residential and commercial pest control services, which may include:
- General pest treatments (ants, spiders, roaches, etc.)
- Rodent control and exclusion
- Termite inspections and treatments
- Bed bug treatments
- Mosquito and outdoor pest services
- Preventative pest maintenance plans
All services are performed in accordance with applicable Arizona state regulations and industry standards.
2. SERVICE AGREEMENTS
By booking services, you agree that:
- You are authorized to approve pest control treatment at the property.
- You will provide accurate property access information.
- You will disclose known pest issues and sensitive conditions (e.g., pets, allergies, pregnancy, medical concerns).
Recurring service plans may require a minimum contract term as disclosed at the time of enrollment.
3. PRICING AND PAYMENT
- Prices are based on property size, infestation level, and treatment type.
- Payment is due at the time of service unless otherwise agreed in writing.
- For subscription or recurring plans, payments will be automatically billed on the agreed schedule.
- Late or failed payments may result in suspension of services and additional fees.
- Late payments are subject to a late fee of 1.5% per month.
- Returned or failed payments incur a $35 fee.
You agree to pay all costs of collection, including reasonable attorneys’ fees and court costs, if we must enforce payment obligations. We reserve the right to modify pricing with reasonable notice.
4. CUSTOMER RESPONSIBILITIES
Customers agree to:
- Prepare property as instructed before treatment
- Vacate treated areas when required for safety
- Keep pets and children away from treated zones until safe re-entry time has passed
- Follow all post-treatment instructions provided by technicians
- Provide technicians reasonable access to the property
Failure to follow instructions may reduce effectiveness of treatment and may void service guarantees.
5. SERVICE GUARANTEE
We may offer service guarantees depending on the plan purchased. Unless otherwise stated:
- Free retreatments may be offered within a defined warranty period for covered pests
- Guarantees do not cover re-infestations caused by structural issues, sanitation problems, third-party treatments or conditions outside the treated area (including neighboring properties).
All guarantees are subject to the Company’s sole discretion and require the customer to remain current on all payments and to follow all instructions.
EXCEPT FOR ANY EXPRESS SERVICE GUARANTEE OFFERED IN WRITING FOR A SPECIFIC PLAN, ALL SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” THE COMPANY DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR RESULTS. PEST CONTROL RESULTS CAN VARY DUE TO FACTORS BEYOND OUR CONTROL, INCLUDING WEATHER, NEIGHBORING PROPERTIES, CUSTOMER MAINTENANCE, AND SANITATION PRACTICES.
6. LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY ARIZONA LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES (INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS, PROPERTY DAMAGE, OR PERSONAL INJURY NOT DIRECTLY CAUSED BY OUR NEGLIGENCE). OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SERVICES, WHETHER IN CONTRACT, TORT, OR OTHERWISE, SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM. This limitation applies even if we have been advised of the possibility of such damages.
7. SAFETY AND CHEMICAL USE
All products used are EPA-registered when required and applied by licensed technicians. However:
- Pest control products may carry risks if misused or accessed improperly.
- Customers must follow all safety instructions provided.
- We are not liable for misuse, tampering, or failure to follow guidance.
8. APPOINTMENTS AND CANCELLATIONS
- Appointments may be rescheduled with reasonable notice.
- Missed appointments or cancellations within 24 hours may be subject to a cancellation fee in the amount of $35.00.
- We reserve the right to refuse service due to unsafe conditions or non-compliance.
9. PROPERTY DAMAGE
We take reasonable care during service. However:
- We are not liable for damage caused by pre-existing conditions or hidden structural issues.
- Any claims for service-related damage must be reported within 48 hours.
10. THIRD-PARTY PRODUCTS AND SERVICES
We may use or recommend third-party products or subcontractors. We are not responsible for:
- Third-party performance
- Product defects not manufactured or applied by us
11. TERMINATION OF SERVICES
We reserve the right to terminate or refuse service if:
- Unsafe conditions exist
- Abuse or harassment occurs
- Payment obligations are not met
- Terms are violated
12. GOVERNING LAW
These Terms are governed by the laws of the State of Arizona. Any disputes arising out of or related to these Terms or our services shall be resolved exclusively in the state or federal courts located in Maricopa County, Arizona. In any legal action or proceeding, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs.
13. CHANGES TO TERMS
We may update these Terms at any time. Continued use of services constitutes acceptance of updated Terms.
14. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless the Company, its owners, officers, employees, agents, and subcontractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your failure to disclose material information about the property, pests, pets, allergies, health conditions, or structural issues; (b) your failure to follow post-treatment instructions or prepare the property as directed; (c) any pre-existing conditions at the property; or (d) your negligence, willful misconduct, or violation of these Terms.
15. Force Majeure
The Company shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including but not limited to acts of God, weather, pandemics, government orders, labor disputes, or supply chain disruptions.
16. Entire Agreement
These Terms of Service, together with our Privacy Policy, any specific service proposal, work order, invoice, or other written agreement you accept or sign, constitute the complete and exclusive agreement between you and Veterans Choice Pest Solutions, LLC concerning the pest control services. They supersede all prior or contemporaneous agreements, understandings, negotiations, representations, or warranties—whether oral, written, or implied. No amendment or modification of these Terms shall be effective unless it is in writing and signed by an authorized representative of the Company.
